В США

Для использования информации по США следует использовать такой алгоритм действий:

  1. Войти на сайт.

  3. Открыть страницу «Индекс классификации» и определите нужную тему.
  4. В разделе «Руководство по классификации» можно уточнить подкласс.
  5. Открыть «Определения классификации» и произвести окончательный выбор класса и подкласса.
  6. Осуществить поиск по классу и подклассу.
  7. Выведенные документы изучаются и копируются при необходимости.
  8. Определяется владелец патента и выявляются иные патенты, принадлежащие компании (по ключевым словам).
  9. Поиск осуществляется до выявления всех патентов, касающихся выбранной темы.

В Европе

По Европе ПП можно произвести через зарубежный сайт Европейской патентной организации. Как проводить патентный поиск:

  1. Открыть сайт.
  2. Вписать ключ и использовать кнопку Search, что позволяет вывести на экран перечень патентов.
  3. Выбрать нужный предмет поиска (следует учитывать языковые особенности написания различных терминов).
  4. С помощью знака «*» выявить весь набор нужных документов по ключу.
  5. Для просмотра аннотации нужного документа надо нажать на его номер.
  6. При необходимости получения более подробной информации нажимается верхнее окно, отображающее страницу текста.
  7. Изучить документы.
  8. Вывести нужные чертежи можно нажатием на окно «Drawings».

Заинтересовавшая информация копируется и используется для дальнейшего анализа.

Патентный поиск необходим для определения новизны решения и исключения нарушения авторских прав, а также для определения уровня развития определенной области. Его можно провести самостоятельно, но для этого необходимо потратить много времени и иметь необходимые технические и юридические познания.

Профессиональный поиск обеспечивают специализированные организации, которые несут ответственность за представленные результаты.

History and background

The service was launched on December 14, 2006. Google says it uses «the same technology as that underlying Google Books», allowing scrolling through pages, and zooming in on areas. The images are saveable as PNG files.

Google Patents was updated in 2012 with coverage of the European Patent Office (EPO) and the Prior Art Finder tool.

In 2013, it was expanded to cover World Intellectual Property Organization (WIPO), German Patent Office (German: Deutsches Patent- und Markenamt, DPMA), Canadian Intellectual Property Office (CIPO), and China’s National Intellectual Property Administration (CNIPA). All foreign patents were also translated to English and made searchable.

In 2015, a new version was introduced at patents.google.com with a new UI, integration of Google Scholar with machine-classified with Cooperative Patent Classifications (CPCs), and search result clustering into CPCs.

In 2016, coverage of 11 additional patent offices was announced. Support for the USPTO and EPO boolean search syntax (proximity, wildcards, title/abstract/claims fields) was introduced, as well as visual graphs of inventors, assignees and CPCs by date, a thumbnail grid view of search results and downloadable result sets as CSV.

In 2018, global litigation information has been added. Google Patents pages display if a patent (or any member of its family) has a litigation history anywhere in the world and provides a link to the Darts-ip patent cases database.

Why Google Patents Search

Because it’s free?!

That’s one advantage but there’s more to Google than the freedom to conduct searches without having to shed a penny.

Though there are other free patent databases as well in the market such as Espacenet, Patentscope, and the like. However, the results displayed on these databases are not so user-friendly, and a user has to do a lot of clicking and “open in new tab” for information that is otherwise readily available for the user’s disposal on the interface of Google Patents.

For example, Google Patents gives the user an option to blow up the figures of a search result if at all the user wishes to focus on the figures of the different patents. A similar feature is not provided by other free databases like Espacenet, Patentscope, and USPTO PAIR.

How about Paid Databases?

Now, paid databases like Patbase, Orbit, Derwent though have a lot of features to offer and are the ideal databases to conduct searches, it is to be noted that the cost of licenses for these databases is not something that an individual inventor would want to invest on.

Also, it is simply impractical to purchase a license for performing one or two searches.

Of course, there is always an option to visit a patent attorney, but if it is not viable (for certain inventors), Google Patents is last and the best resort.

Apart from being free, Google Patents has certain advantages over paid databases, listed as follows:

  • User-Friendly Interface – The interface of Google Patents is so sleek & intuitive that it comes as a surprise that a service like that is being offered for free;
  • Fast – The results are obtained within a fraction of seconds;
  • Easily shareable results;
  • Legal Events information – The sequence of the legal events is very systematically provided; and

Presentation of information – The way the patent is displayed makes it very easy to study, with the claims provided on the right-hand side of the screen and the description provided on the left.
